Proof of Delivery and Risk TransferUpdated 2 months ago

This section explains your rights and our responsibilities regarding the delivery of your order, how we confirm that delivery has taken place, and when the risk of loss or damage transfers from us to you.

1. Relevant EU Law

a) Directive 2011/83/EU (Consumer Rights Directive)
The seller must deliver goods without undue delay and no later than 30 days after the contract is concluded, unless another date is agreed. Responsibility for the goods remains with the seller until they are handed over to the consumer or a third party designated by the consumer.

b) Directive (EU) 2019/771 on Contracts for the Sale of Goods
This directive states that the relevant time for assessing conformity is when the goods are delivered. If a lack of conformity appears within one year of delivery, it is presumed to have existed at delivery. National laws determine how delivery obligations are fulfilled.

c) Proof of Delivery & Risk Transfer
When the seller arranges delivery, they bear the risk until the goods are delivered to the consumer or their designated recipient. Sellers must maintain records (tracking numbers, delivery scans, signatures) to prove delivery. Lack of proof may affect liability.

2. Why This Matters to You

  • Delivery Date Definition: Your order is considered delivered when handed to you or your designated recipient, or upon the first delivery attempt or delivery notice.

  • Proof of Delivery: We keep delivery evidence to confirm your order’s arrival. Without it, you could claim non-receipt, which may require us to offer remedies.

  • Policy Alignment: Our delivery terms follow EU law — goods delivered without undue delay, responsibility transfers upon handover, and full transparency on delivery conditions.

3. Refunds and Delivery Claims

We always strive to provide excellent service and thoroughly investigate all claims of lost or undelivered orders, relying on carrier tracking, delivery confirmations, and your provided delivery instructions. However, if your order is confirmed as delivered according to your instructions, refund requests may be denied to prevent misuse. False claims of non-receipt are taken seriously and may result in legal action.

4. Important Disclaimer

The delivery date is when your package is handed over to you or a designated recipient, or when the first delivery attempt or notice is logged—unless otherwise agreed in writing.

We use third-party carriers and rely on their tracking and delivery records as proof of delivery. If a package is reported as delivered, we may ask for supporting evidence and rely on the carrier’s confirmation.

Until delivery or the first attempt, the risk of loss or damage remains with us. After that, and once you have or should reasonably have collected the package, the risk transfers to you.

If your package cannot be collected from a delivery point (e.g., locker too small or inaccessible), this may affect delivery timing. Please follow any carrier or Globe instructions promptly to avoid delays or returns.

This disclaimer does not limit your statutory rights under EU or national consumer laws, including Directive 2011/83/EU and Directive (EU) 2019/771.
